1220 Collins Ave, Inc., d/b/a The Webster' s ("The Webster", "we" or "us") website (our "Website", Site", "Sites" or "thewebstermiami.com") and related services are made available to you pursuant to the following Terms of Use & Service and any other rules posted on our Sites (collectively, the "TOS").

When you register, you are required to provide information about yourself that is true, accurate, current and complete in all respects. The Webster does not promise that the functional aspects of the Site or The Webster The Webster 's Content will be error free or that this Site, The Webster Content or the server that makes it available are free of viruses or other harmful components. We always recommend that all users of the Internet ensure they have up to date virus checking software installed.
Non-Commercial Use:
This Site is for your personal, non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any Content, software, products, or services contained within this Site. You acknowledge and agree that no joint venture, partnership, employment, or agency relationship exists between you and The Webster as a result of the TOS or your use of this Site. You agree that you may not and will not hold yourself out as a representative, agent, or employee of The Webster, and we shall not be liable for any representation, act, or omission on your part.
No Waiver:
If you breach the TOS and we take no action against you, we will still be entitled to use our rights and remedies in any other situation where you breach the TOS.
Governing Law:
The TOS together with all our policies and procedures will be governed by and construed in accordance with the laws of the State of Florida and the relevant courts of Florida will have exclusive jurisdiction.

The Webster also collects simple user information by using data-tracking software to track what areas of the site are visited most frequently. This gives us valuable information about those items in which our customers are most interested so we can try to provide a better shopping experience.

If you are a registered user of the Webster, we will securely store your credit card details on our systems. These details will be fully encrypted and only used to process card transactions initiated by you.
To help ensure that your shopping experience is safe, simple and secure The Webster uses Secure Socket Layer (SSL) technology.
Furthermore, we will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Site.

4. Ordering & Payments
Acceptance of your Order:
Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email will be titled “Order Acknowledgment” and is NOT an acceptance of your order, just a confirmation that we have received it.
Acceptance of your order and completion of the contract between you and The Webster occurs when we email you to confirm the goods have been dispatched.This email will be titled “Order Fulfillment”. The sale contract is therefore concluded in Florida, USA, and the language of the contract is English.
You may cancel your order between the time you receive the Order Acknowledgment email and the Order Fulfillment email.
We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out within the TOS.
Payment:
Payment can be made by Visa, MasterCard, American Express, Discover, and any other methods that may be clearly advertised on the Site from time to time.
Payment will be debited and cleared from your account upon dispatch of your order by The Webster. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to The Webster, we will not be liable for any delay or non-delivery.
5. Returns & Exchanges
General Conditions:
Exchange requests or returns on FULL-PRICED merchandise are accepted by mail or in The Webster store with the original receipt within 7 business days of receipt of purchase
PLEASE NOTE:All SALE purchases are FINAL SALE.Please shop carefully as returns or exchange requests on SALE merchandise will not be accepted.
The first step in processing your return is to obtain a Return Merchandise Authorization (RMA) number from The Webster. This RMA number should be requested by sending an email to customercare@thewebstermami.com within 24 hours of receiving your order. In this email, you should describe the reason for the return or the exchange. Unidentified returns may be returned to the sender. Please note that issuance of a RMA does not guarantee a replacement or a refund. Acceptance of a Return or Exchange:Please not that Items should be returned unused and with all Webster and designer garment tags still attached (please see instructions below).. Returns that are damaged or soiled may not be accepted and may be returned to the customer.
Where provided, belts and any designer packaging such as authenticity cards, dust bags and leather tags should be included with your return. Please email customercare@thewebstermiami.com if any of your purchases have been delivered without Webster tags. All shoes should be tried on a carpeted surface before wear. Briefs, bathing suits and bikini bottoms should be tried on over underwear, without removing the protective adhesive strip, where such strips exist. Returns that do not have this strip or which are soiled may not be accepted, and may be sent back to the customer without a refund.
Colors:We have made every effort to display as accurately as possible the colors of our products that appear on the Site. We cannot guarantee that your computer monitor's display of any color will be accurate.
Damaged Package:Please inspect your package carefully and refuse delivery if the package is visibly damaged. If you do not refuse shipment and realize the package is damaged at a later moment, please maintain the original packaging and try to take a picture of it. Please contact customercare@thewebstermiami.com with 24 hours to confirm that said damage happened during shipping and is not a result of use or misuse of the product.
Faulty Goods:Goods may be considered faulty if they are damaged at the moment they were received. Please note that items that are damaged as a result of normal wear and tear are not considered to be faulty. If you would like to exchange a faulty item (instead of obtaining a refund), please be aware that we can only replace it for the same product in the same size, subject to availability. Where possible, we will offer to repair faulty items. If it cannot be repaired or the same product is not available, you are entitled to a full refund or a store credit.
Shipping Exchanges and Returns:
Please note we can only exchange items for a different size, based on stock availability.
Shipping is complimentary on the replacement item, but exchanges made to destinations outside of the U.S. will be processed for customs clearance and therefore any relevant import duty and tax charges will apply.
By Mail – FREE: With your RMA, you will receive a pre-paid RETURN LABEL (insurance included). Place the RMA inside the box, use the RETURN LABEL and drop your exchange at a UPS store. Once received, we will process your exchange and mail back to the original shipping address processed with your order.
6. Shipping Policy
Orders are processed Monday through Friday, excluding holidays. Orders received on week days after 12pm EST, or on weekend days or on holidays will begin processing the next business day. Shipping times may vary due to availability of merchandise.
Shipping Options:
The Webster offers three types of shipping options for delivery within the United States. At this time, we are unable to ship to P.O. Boxes or APO addresses.
All packages are shipped via UPS and we offer the following shipping options:
- Ground (5 to 7 business days) : $15
- 2nd Day Air (2 business days): $30
- Next Day Air (1 business day): $50
Please note that from time to time The Webster will offer free Ground shipping on all purchases over $500, excluding taxes. This is a temporary promotional offer and The Webster is in no way obligated to keep that offer in place.
International Shipping:
Customers purchasing from a country other than the US will be served as DDU (Delivery Duty Unpaid), and will be charged for the items purchased and shipping costs only. Import duty or tax costs will be invoiced to you directly from DHL or an import broker appointed by you. We recommend you contact your local customs authority to determine a landed cost price prior to purchase completion. Please note that we aim to dispatch all orders within 48 hours. Estimated delivery times are to be used as a guide only and commence from the date of dispatch, The Webster is not responsible for any delays caused by destination customs clearance processes.
Tracking your order:
You can check the current status of your shipment by signing into your account and selecting ORDER STATUS. Simply type in your unique air waybill number, which we emailed to you in our Order Fulfillment email, and we will track your shipment for you.
The Webster will store a record of your transactions for a minimum of one year.
Insurance & Delivery:
The Webster insures each purchase during the time it is in transit until it is delivered to your specified delivery address. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfillment by The Webster and transfer of responsibility in the same way
